• Purchase subscription plans or credit packs to obtain note generation credits
• Convert articles, audio files, PDFs, and other content formats into hand-drawn visual notes
• Use AI to intelligently extract key insights, core points, and critical information from your content
• Generate professional visual notes with clear structure and easy-to-remember formats
• Access and manage your generated notes through your account

Credit System: Our Service operates on a credit-based system. When you purchase a subscription plan or credit pack, you receive a certain number of credits. Each time you generate a visual note from content, a specified number of credits are consumed from your account balance. Credits are non-transferable and have no cash value.

3. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Accept all risks of unauthorized access to your account

Our Service offers subscription plans and one-time credit packs. By purchasing any service, you agree to the following:

Subscription Plans

• Subscriptions are billed on a recurring basis (monthly or yearly) as selected during purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• You will receive credits at the beginning of each billing cycle according to your plan
• Unused credits from previous billing cycles do not roll over unless explicitly stated in your plan
• You may cancel your subscription at any time, but cancellation does not entitle you to a refund for the current billing period

Credit Packs

• Credit packs are one-time purchases that add credits to your account immediately upon payment confirmation
• Credits from credit packs do not expire unless otherwise stated
• Credit packs are non-refundable once purchased, except as stated in our Refund Policy

General Payment Terms

• All payments are processed through secure third-party payment providers
• You are subject to the payment provider's terms and conditions
• All fees are non-refundable except as explicitly stated in our Refund Policy
• You are responsible for all applicable taxes, duties, or fees imposed by your jurisdiction
• We reserve the right to change our pricing at any time, with notice provided to existing subscribers
• Price changes will apply to new billing cycles for existing subscribers

7. Generated Content and Intellectual Property

Your Content: You retain all ownership rights to the original content you submit to our Service (articles, audio, PDFs, etc.). By submitting content, you grant us a limited license to process and transform your content solely for the purpose of generating visual notes as requested.

Generated Notes: Visual notes generated by our Service are created for your use. You own the generated visual notes and may use them for personal or commercial purposes, subject to these Terms. However, you acknowledge that:

• Generated notes are created using AI technology and may contain inaccuracies or errors
• We do not guarantee the accuracy, completeness, or quality of generated notes
• You are solely responsible for reviewing and verifying the accuracy of generated notes before use
• You may not use generated notes in any way that violates applicable laws or infringes upon third-party rights

Service Technology: The Service, including all software, algorithms, AI models, and technology used to generate notes, remains the exclusive property of SketchAI and its licensors. You may not reverse engineer, copy, or attempt to extract the underlying technology.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SKETCHAI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:

• Use or inability to use the Service
• Errors, inaccuracies, or omissions in generated notes
• Loss of credits due to technical issues or service interruptions
• Unauthorized access to or alteration of your content or account
• Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

9. Indemnification

You agree to defend, indemnify, and hold harmless SketchAI and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to:

• Your use of generated notes in violation of applicable laws or third-party rights
• Your submission of content that infringes upon intellectual property rights
• Any unauthorized use of your account
• Your violation of any provision of these Terms

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. The following will apply:

• Your subscription will be cancelled, and no further charges will be made
• Unused credits in your account will be forfeited unless otherwise required by law
• You may lose access to generated notes stored on our servers
• All provisions of the Terms which by their nature should survive termination shall survive termination

11. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Material changes will be communicated via email to the address associated with your account or through a prominent notice on our Service.

Your continued use of the Service after any changes to these Terms constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which SketchAI operates, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
